The NBA is quickly trying to move on from the problem caused by Warner Brothers Discover / TNT by asking the Supreme Court of New York to dismiss the case brought by the Media conglomerate.
The lawsuit alleges that the NBA breached its contract by rejecting WBD's proposal for a new media rights deal and signing with Amazon.
In a 28-page filing, along with supporting documents, the division asked the court to dismiss the case out of favor, so it will not be reviewed in the future.
The NBA claims that WBD (the parent company of Turner / TNT Sports) attempted to improperly rewrite Amazon's gift terms and accept those terms.
“TBS has opted out of NBCUniversal's offer, which would have allowed TBS to continue to distribute games through its linear cable network TNT,” the league said, according to ESPN. “Instead, TBS was supposed to match Amazon's less expensive offering, but only after revising it to include traditional distribution rights and making other major changes.”
The NBA says WBD “made robust revisions to eight of 27 Amazon categories (including revisions to 22 separate categories), changed 11 jointly defined terms that were used approximately 100 times separately, and affected nearly 300 terms , and added more than 270 new words. , which has significantly changed the rights and obligations of organizations in this process.”
The league says the WBD approach for distribution (linear television) means the organization should have matched NBC's $2.45 billion annual offer, not the cheaper $1.8 billion offer — which Amazon made just for distribution.
The NBA's attorneys continued, “Far from accepting Amazon's offer per se, the TBS review constituted a counter offer that the NBA was free to reject.”
TNT Sports still insists it has fulfilled its contractual right to match the third party's offer.
“Not only is it our contractual right, but it is of great benefit to fans who want to continue to enjoy our industry-leading NBA content with the choice and flexibility we offer them through our widely distributed platforms including TNT and Max,” TNT said. “We will file our objections in the coming weeks.”
